| dc.description.abstract | O Código Florestal (Lei 12.651/2012) implementou inovações no regramento das Áreas de Preservação Permanente (APP), especialmente ao autorizar a continuidade de atividades agrossilvipastoris nas áreas rurais consolidadas. Esta pesquisa buscou analisar as implicações dessas inovações por meio da identificação do uso e cobertura das APP de cinco propriedades rurais produtoras de leite, localizadas no Vale do Taquari, e a subsequente aplicação das regras do Código Florestal a estas. O trabalho discorre sobre a evolução da tutela jurídica do meio ambiente nos âmbitos internacional e nacional, o desenvolvimento das áreas de proteção na legislação brasileira, passando-se à contextualização da regulamentação das APP no Código Florestal. A pesquisa adotou o método dedutivo. A abordagem metodológica utilizada foi a quali-quantitativa, partindo-se dos dados quantitativos levantados pelo projeto “Sustentabilidade em propriedades rurais produtoras de leite” para a seleção de cinco propriedades a serem analisadas qualitativamente. Foram adotados os procedimentos técnicos de estudo de campo, utilizando-se os dados das propriedades obtidos no referido projeto, e estudo de caso, com a confecção de mapas para identificar o uso e cobertura de suas APP em 2018 e em 2008. A partir dos mapas e respectivos dados, se identificou as áreas que devem ser recuperadas e respeitadas em cada propriedade frente às normas do Código Florestal. A análise apontou que as áreas totais a serem respeitadas em cada propriedade representam 10,64%, 5,10%, 59,77%, 81,63% e 98,37% de suas respectivas APP. Os resultados indicaram que as inovações trazidas pelo Código Florestal ocasionam significativa redução na área da APP a ser respeitada, dependendo da situação do imóvel. Os dados também apontaram que essas inovações acarretam em medidas de proteção díspares entre as propriedades, impondo ônus maiores àquelas em que a vegetação nativa foi mais preservada. Naquelas propriedades em que a área a ser respeitada limita-se às faixas de recomposição previstas no artigo 61-A do Código, suas APP não serão suficientes para cumprir com sua função socioambiental. | pt_BR |
| dc.description.abstract | The Forest Code (Law 12.651/2012) implemented innovations in the Permanent Preservation Areas (PPA) regulations, especially when authorizing the continuity of silvopasture agroforestry activities in the consolidated agricultural areas. This research aimed to analyze the implications of these innovations through the identification of the land use and cover of the PPAs in five dairy producing rural properties located in the Taquari Valley, and subsequent application of the Forest Code rules to them. The work discusses the evolution of the legal guardianship of the environment in the international and national scopes, the development of the protection areas in Brazilian legislation, moving to the contextualization of the PPAs regulation in the Forest Code. The research adopted the deductive approach. The methodological approach used was the quali-quantitative, starting with the quantitative data raised by the “Sustainability in dairy producing rural properties” project for the selection of the five properties to be qualitatively analyzed. The technical procedures adopted were the field research, using the properties data collected in the referred project, and the case study, when maps were made to identify the land use and cover of its PPAs, in 2018 and in 2008. Through the maps and respective data, the areas that must be restored and respected in each property, according to the norms of the Forest Code, were identified. The analysis pointed that the total areas to be respected in each property represent 10.64%, 5.10%, 59.77%, 81.63% and 98.37% of its respective PPAs. The results indicated that the innovations presented by the Forest Code lead to significative reduction on the PPA area to be respected, depending on the property condition. The data also pointed that these innovations determine unequal protection measures among the properties, imposing bigger onus to those where the native vegetation was most preserved. In those properties where the area to be respected is limited to the restoration bands provided for in the article 61-A of the Code, its PPAs will not be enough to fulfill its socio-environmental role. | pt_BR |
