Registro de imóveis na região oeste do Pará: dificuldades encontradas na regularização fundiária sustentável e as (im)possibilidades de mitigação

Resumo
Esta dissertação tem como objetivo geral identificar os obstáculos que o poder público enfrenta para efetuar, com eficácia, a regularização fundiária sustentável na região oeste do Pará e propostas de mitigação. Enquanto objetivos específicos encontra-se: i) Identificar as leis que regulamentaram, ao longo da história, a regularização fundiária no Pará; ii) Identificar quais os principais fatores que têm impedido as autoridades de fiscalizar com eficácia as terras; iii) Apontar as possíveis medidas legais e administrativas necessárias, indicando aspectos ambientais, econômicos e sociais, positivos e negativos da regularização fundiária. Para tanto, no que diz respeito à metodologia, para além do levantamento bibliográfico, aplicou-se um questionário a cinco servidores públicos que trabalham com o cadastro de terras da região Oeste do Pará. O referencial teórico possui aporte, essencialmente, em Harvey (1996), Castells (1980) e Albuquerque (2000). Ao final deste trabalho, conclui-se que a principal dificuldade, na maioria dos municípios dessa região, é a falta de interesse das gestões municipais em executar e desenvolver as políticas públicas de regularização, emissão de títulos, cadastramento e mapeamento, conforme a lei. Ademais, pensar nesse cenário implica trabalhar com políticas favoráveis que garantam a estabilidade e a equidade social, cultural, política e econômica das comunidades humanas.
This dissertation has as general objective to identify the obstacles that the public authorities face to effectively carry out the sustainable land regularization in the western region of Pará and mitigation proposals. As specific objectives are: i) Identify the laws that have regulated, throughout history, land tenure regularization in Pará; ii) Identify the main factors that have prevented the authorities from effectively inspecting the land; iii) Point out the possible legal and administrative measures necessary, indicating environmental, economic and social, positive and negative aspects of land title regularization. Therefore, with regard to the methodology, in addition to the bibliographic survey, a questionnaire was applied to five public servants who work with the land registry in the western region of Pará. The theoretical framework is essentially based on Harvey (1996) ), Castells (1980) and Albuquerque (2000). At the end of this work, it is concluded that the main difficulty, in most municipalities in this region, is the lack of interest of municipal administrations in executing and developing public policies for regularization, issuance of titles, registration and mapping, according to the law. Furthermore, thinking about this scenario implies working with favorable policies that guarantee the stability and social, cultural, political and economic equity of human communities.
