O presente trabalho aborda o estudo sobre as medidas socioeducativas cumpridas em meio aberto aplicadas ao adolescente infrator na cidade de Lajeado/ RS no ano de 2016. O trabalho busca como objetivo geral, estudar a (in)eficácia dessas medidas, no sentido de inibir que o adolescente retorne a prática de ato infracional. Trata-se de pesquisa quali-quantitativa, realizada por meio de método técnico bibliográfico-documental e análise de dados. Inicialmente, será feito um estudo contextual de como crianças e adolescentes eram definidos nas legislações passadas, após analisar-se-á a Doutrina da Proteção Integral e sua inserção no Estatuto da Criança e do Adolescente. Da mesma forma, haverá a descrição sobre a criação do Estatuto da Criança e do Adolescente e, os direitos e garantias processuais do adolescente, e, a explanação sobre inimputabilidade penal. Em seguida, faz-se um estudo sobre ato infracional e medidas socioeducativas. Por fim, analisam-se dados coletados em pesquisa de campo realizada no CREAS e SIMASE de Lajeado/RS, a fim de concluir sobre a (in)eficácia das medidas socioeducativas, o índice de novas infrações após o cumprimento da medida e a descrição de possíveis alternativas para evitar que o adolescente retorne à prática de atos infracionais. Sendo assim, conclui-se que as medidas socioeducativas impostas ao adolescente no ano de 2016 em meio aberto foram eficazes, pois o índice de novos atos infracionais após o cumprimento da medida foi relativamente baixo.
The present study approaches the study about correctional measures complied in open way applied to the teenager offender in the city of Lajeado/RS in the year of 2016. The research seeks as general objective study the (in)effectiveness of those measures, in the sense of inhibit the teenager from returning to the practice of infractional acts. This is qualitative-quantitative research, held by bibliographical-documental technical method and data analysis. Initially, a contextual study will be done on how children and teenagers were defined in the past laws; after that, the Doctrine of Integral Protection will be analyzed, as well as its insertion in the Statue. Subsequently, there will be a description on the creation of the Statute of the Child and the Teenager, the rights and procedural guarantees of the teenager, and the explanation of criminal responsibility. Furthermore, a study about infraction acts and correctional measures will be hold. Finally, data collected in a field research performed in CREAS and SIMASE of Lajeado/RS will be analyzed, in order to conclude about the (in)effectiveness of correctional measures and the index of new infractions after the compliance and description of alternatives to prevent the teenager from returning to the practice of infractional acts. The conclusion therefore is that correctional measures imposed on teenager in the year of 2016 in open way were effective, since the index of new infractions after the compliance of the measure was relatively low.
