Versa o presente artigo sobre o estudo do reconhecimento pessoal como meio de prova no processo penal brasileiro, analisando sua evolução histórica, conceitos fundamentais e as posições dos tribunais superiores a respeito do tema. Em sede de introdução, delimita-se o objeto de estudo e a relevância do reconhecimento pessoal no contexto do processo penal. O primeiro capítulo abordará o contexto histórico do processo penal brasileiro, traçando uma linha temporal desde o período colonial e imperial até a Constituição Federal de 1988 (CF/88), a qual trouxe avanços importantes no ordenamento jurídico brasileiro. No segundo capítulo, será explorada a teoria geral da prova no processo penal, com foco no reconhecimento pessoal e sua qualificação como meio probatório, investigando critérios que validem a segurança da prova, assim como os riscos de sua utilização quando realizada sem observância das formalidades previstas em lei. O terceiro capítulo tratará os precedentes jurisprudenciais relacionados ao reconhecimento pessoal, examinando decisões relevantes do Supremo Tribunal Federal (STF), do Superior Tribunal de Justiça (STJ) e do Tribunal de Justiça do Rio Grande do Sul (TJRS). Analisa-se o entendimento desses tribunais sobre a validade e a força probatória do reconhecimento pessoal, com atenção especial ao cumprimento das formalidades previstas no art. 226, do Código de Processo Penal. Este estudo, portanto, busca compreender a importância do reconhecimento pessoal no processo penal, os desafios de sua aplicação e os parâmetros estabelecidos pelos tribunais para garantir que essa prova seja utilizada de maneira justa e segura no Estado Democrático de Direito.
This article focuses on the study of personal recognition as a means of proof in Brazilian criminal proceedings, analyzing its historical evolution, fundamental concepts and the positions of higher courts on the subject. In the introduction will be presented, delimiting the object of study and the relevance of personal recognition in the context of criminal proceedings. The first chapter will address the historical context of the Brazilian criminal process, tracing a timeline from the colonial and imperial period to the Federal Constitution of 1988 (CF/88), which brought important advances in the Brazilian legal system. In the second chapter, the general theory of evidence in criminal proceedings will be explored, focusing on personal recognition and its qualification as a means of evidence, investigating criteria that validate the security of evidence, as well as the risks of its use when carried out without observing the prescribed formalities in law. The third chapter will deal with jurisprudential precedents related to personal recognition, examining relevant decisions from the Federal Supreme Court (STF), the Superior Court of Justice (STJ) and the Court of Justice of Rio Grande do Sul (TJRS). The understanding of these courts on the validity and probative force of personal recognition is analyzed, with special attention to compliance with the formalities provided for in art. 226 of the Criminal Procedure Code. This study, therefore, seeks to understand the importance of personal recognition in the criminal process, the challenges of its application and the parameters established by the courts to ensure that this evidence is used fairly and safely in the Democratic Rule of Law.
