O diálogo competitivo em análise de direito comparado entre Brasil e Portugal: avanços ou retrocessos?

Resumo
Com a aproximação da revogação da Lei n.º 8.666/93 pela nova Lei Geral de Licitações e Contratos Administrativos - Lei n.º 14.133/21 -, a Administração Pública vive um período de evolução e transformação. Dentro das inovações trazidas pelo novo diploma legal, cabe destaque a valorização e promoção da interação entre o setor público e privado. Nesta realidade, surge no direito brasileiro o Diálogo Competitivo, modalidade licitatória por meio da qual a Administração Pública dialoga com interessados capacitados da iniciativa privada, visando encontrar as melhores soluções para as suas necessidades. Para o presente artigo, optou-se pelo uso do tipo de pesquisa dedutivo, com caráter exploratório e bibliográfico/documental. Quanto ao método de pesquisa, o presente estudo foi desenvolvido de maneira dedutiva e a metodologia enquanto direito comparado é declaratória. Sabe-se que o Diálogo Competitivo, agora presente no Direito brasileiro, foi inspirado no direito europeu, desta forma, realizou-se um estudo de direito comparado entre Brasil e Portugal, visando resolver a seguinte problemática: O Diálogo Competitivo em Análise de Direito Comparado entre Brasil e Portugal - Avanços ou Retrocessos? Como resultado deste estudo comparativo, foram identificados alguns pontos cruciais para o sucesso do método licitatório estudado, quais sejam a segurança jurídica, a correta fiscalização do procedimento e a adequada capacitação dos agentes públicos. Ainda, verificou-se que o Diálogo Competitivo no Direito Administrativo brasileiro segue rigorosa aplicação, trazendo potencial inovativo para a Administração Pública, bem como garantindo a segurança de sua aplicação.
Considering the approximation of the revocation of the law n.º 8.666/93 in face of the new General Law of Bidding and Administrative Contracts - Law n.º 14.133/21 -, the Public Administration lives evolutionary and transformative times. Inside the innovations brought by the new legislation, deserve the highlights the valuation and promotion of the integration between the public and the private sectors. In this reality, comes up in brazilian law the Competitive Dialogue, a bidding modality whereby the Public Administration dialogues with capacitated interested from the private initiative, aiming to find the best solutions to its needs. For the present article, it was chosen the qualitative search mode, with exploratory and bibliographic/documental character. As for the search method, the present study was developed deductively and the methodology as comparative analysis is declaratory. It’s known that the Competitive Dialogue, now present in the brazilian law, was inspired in european laws, so, it was developed a study of comparative analysis between Brazil and Portugal, aiming to solve the following problem: The Competitive Dialogue in Comparative Law Analysis Between Brazil and Portugal - Advances or Setbacks? As result of the present study, it was identified some key points required to the success of the bidding modality that is the object of this article, which are the legal security, the precise oversight of the procedure and the correct capacity of the public agents. Still, it was verified that the Competitive Dialogue in the brazilian Administrative law follows rigorous application, bringing innovative potential to the Public Administration and granting the security of its application.
