Abstract
O presente trabalho pretende abordar a eficácia dos direitos fundamentais sociais dos trabalhadores migrantes no Brasil a partir de uma perspectiva do acesso à Justiça do Trabalho. Neste sentido, a investigação parte de uma análise das características humanas quanto a seus hábitos de existência em razão do local e das razões dos movimentos migratórios, buscando-se conectar tais deslocamentos com a força de trabalho. Em seguida, examina-se a temática dos direitos humanos e fundamentais a partir de seu núcleo central de dignidade da pessoa humana, igualmente correlacionando tais conceitos com o valor universal do trabalho humano como fator efetivamente capaz de promover desenvolvimento social sustentável, conforme estabelecido no Objetivo de Desenvolvimento 8 da chamada Agenda 2030 para o Desenvolvimento Sustentável. A partir desta correlação de conceitos com a temática do Desenvolvimento Sustentável, o trabalho apresenta levantamento mediante o qual se pretende avaliar o nível de satisfação geral dos direitos fundamentais destes trabalhadores, a partir de seu efetivo acesso à Justiça do Trabalho do âmbito do Tribunal Regional do Trabalho da 4a Região, mediante levantamento de dados relativos aos processos ajuizados por imigrantes, com as suas respectivas soluções – procedência, procedência parcial e improcedência –, durante os anos de 2018, 2019 e 2020 no Estado do Rio Grande do Sul.
This paper aims to address the effectiveness of the migrant workers fundamental social rights in Brazil from the perspective of access to labor justice. In this sense, the investigation is based on an analysis of human characteristics regarding their habits of existence due to the location and the reasons of migratory movements, seeking to connect such displacements with the workforce. Next, the theme of human and fundamental rights is examined from its central core of human dignity, also correlating these concepts with the universal value of human work as a factor effectively capable of promoting sustainable social development, as established in Development Objective 8 of the so-called 2030 Agenda for Sustainable Development. Based on this correlation of concepts with the theme of Sustainable Development, the paper presents a survey by which it is intended to evaluate the level of general satisfaction of these workers fundamental rights, based on their effective access to the Labor Court within the scope of the Regional Labor Court of the 4th Region, through a survey of data related to the cases filed by immigrants, with their respective solutions – acceptance, partial acceptance and rejection – during the years of 2018, 2019 and 2020 in the State of Rio Grande do Sul.
