Abstract
O presente artigo tem como objetivo verificar se a Lei da Palmada (Lei 13.010/14) cumpriu com seu objetivo de combater a violência praticada pelos responsáveis contra crianças e adolescentes tendo como base pesquisas bibliográficas sobre o assunto. Em virtude disso, o estudo será conduzido a partir do seguinte questionamento: A Lei da Palmada (Lei 13.010/14) traz acolhimento, políticas públicas e melhorias no sentido de eliminar a violência infantil no seio familiar? E por fim, quais as consequências psicológicas da criança e do adolescente expostos a violência como forma de educação? Assim, será abordada a problemática da agressão como forma de educação e punição no Brasil e o histórico da evolução dos direitos das crianças e dos adolescentes no país e no mundo Após, verificar-se-á a legislação brasileira no combate a violência infantil e finaliza-se apresentando a atuação da Lei da Palmada (Lei 13.010/14) no combate à violência infantojuvenil. Utilizou-se da pesquisa qualitativa, realizada pelo método dedutivo, por meio de instrumentos técnicos bibliográficos, a partir da qual constatou-se a contemporaneidade deste problema social. Verificou-se, através do presente artigo, que a Lei da Palmada (Lei 13.010/14) não cumpriu com seu objetivo de diminuir os casos de violência contra crianças e adolescentes, bem como que existem consequências psicológicas decorrentes da exposição à violência.
The aim of this article is to verify whether the Law on Spanking (Law 13.010/14) has fulfilled its objective of combating violence practiced by guardians against children and adolescents, based on bibliographical research on the subject. As a result, the study will be based on the following question: Does the Palmada Law (Law 13.010/14) bring welcome, public policies and improvements to eliminate child violence in the family? And finally, what are the psychological consequences for children and adolescents exposed to violence as a form of education? The problem of aggression as a form of education and punishment in Brazil and the history of the evolution of children's and adolescents' rights in the country and the world will then be addressed. Brazilian legislation to combat child violence will then be examined, and the Law on Spanking (Law 13.010/14) will be presented as a means of combating violence against children and adolescents. Qualitative research was used, carried out using the deductive method and bibliographic technical instruments, which revealed the contemporary nature of this social problem. This article found that the Spanking Law (Law 13.010/14) has not achieved its objective of reducing cases of violence against children and adolescents, and that there are psychological consequences resulting from exposure to violence.
