dc.description.abstractA proteção jurídica e patrimonial do meio ambiente natural significa, na perspectiva interdisciplinar e multidimensional das Ciências Ambientais, a garantia da manutenção do equilíbrio ecológico, da qualidade e da diversidade ambiental, prevista no artigo 225, caput, da Carta Magna de 1988. Constata-se, pois, uma crise socioambiental que se alastra pelas fronteiras globais atingindo, sobretudo, as Unidades de Conservação em razão da fragmentação da cidadania, da justiça e da percepção ambiental das instituições sobre o reconhecimento patrimonial dessas áreas. É uma crise de efeitos progressivos que destrói Reservas Ecológicas, Áreas de Preservação Permanente e Unidades de Conservação que formam a história e a memória ambiental, representando, nesse contexto, uma verdadeira crise de civilização, inclusive, no âmbito dos processos ambientais. A Área de Proteção Ambiental do Inhamum é uma Unidade de Conservação Municipal situada na cidade de Caxias, no Estado do Maranhão, que poderá sofrer os efeitos desta crise. Como problematização central da pesquisa investigou-se como os atores sociais da justiça local têm percebido o Patrimônio Ambiental na área de Proteção Ambiental do Inhamum, Caxias, Maranhão, no que tange ao seu reconhecimento, defesa, proteção e promoção? Os atores sociais públicos da Justiça Ambiental no Município de Caxias – juízes, promotores da justiça estadual, procuradores federais e advogados membros da Comissão temática de Meio Ambiente - estão localizados na chamada “Cidade Judiciária”, e são responsáveis pela defesa desses espaços. Diante disso, por objetivo geral fez-se necessário analisar a Percepção Ambiental dos atores sociais da justiça local sobre a área de Proteção Ambiental Municipal do Inhamum, Caxias, Maranhão, enquanto Patrimônio Ambiental Municipal, identificando os elementos socioambientais da área de proteção; compreendendo o seu processo de evolução normativa para Proteção do Patrimônio em face dos Objetivos do Desenvolvimento Sustentável na Agenda 2030; identificando, ainda, o perfil formativo e educativo desses atores, seus movimentos perceptivos e as suas construções de pertencimento em face desta área. Do ponto de vista metodológico, quanto ao método ou tipo de pesquisa, recorreu-se ao estudo de caso, através de uma pesquisa descritiva explicativa, em que se analisaram os elementos relacionados ao fenômeno da Percepção Ambiental Patrimonial. O delineamento técnico estrutural da pesquisa foi representado, também, pela pesquisa bibliográfica e documental. Para realizar o estudo utilizou-se, a pesquisa de levantamento ou survey, por meio de aplicação de questionários semiestruturados. Quanto ao modo de ser abordada, a pesquisa assumiu uma formatação quali-quantitativa. Os resultados da pesquisa demonstraram que percepções ambientais fragmentadas, desprovidas de interações com as áreas ambientais com as quais se decide ou se postula, podem gerar erros e danos processuais coletivos na seara ambiental, exigindo-se com isso um realinhamento funcional e postural com o ODS 16 – Paz, Justiça e Instituições Eficazes, qual seja, uma maior qualidade e eficiência nas decisões judiciais ambientais. Apesar de possuírem competência legal para decidirem ou postularem sobre a APA do Inhamum, uma parcela significativa dos sujeitos entrevistados não conhece, integralmente e em profundidade, a Unidade de Conservação Local ou, apenas, já ouviu falar vagamente sobre a área, o que demonstrou possuírem um tecido perceptivo fragmentado. Os sujeitos da justiça ambiental reconheceram que o Patrimônio Ambiental, no município de Caxias, não está preservado, necessitando de intervenções conjuntas. A construção de Percepções Ambientais – condignas com as causas ambientais – constitui-se como elemento cognitivo e efetivo de filtragem constitucional ambiental para o acesso a uma ordem jurídica mais justa, do ponto de vista ecológico, para as presentes gerações e para as gerações futuras.
dc.description.abstractThe legal and patrimonial protection of the natural environment means, from the interdisciplinary and multidimensional perspective of Environmental Sciences, the guarantee of the maintenance of ecological balance, quality and environmental diversity, provided for in article 225, caput, of the 1988 Magna Carta. There is, therefore, a socio-environmental crisis that spreads across global borders, affecting, above all, Conservation Units due to the fragmentation of citizenship, justice and the environmental perception of institutions regarding the heritage recognition of these areas. It is a crisis with progressive effects that destroys Ecological Reserves, Permanent Preservation Areas and Conservation Units that form environmental history and memory, representing, in this context, a true crisis of civilization, including within the scope of environmental processes. The Inhamum Environmental Protection Area is a Municipal Conservation Unit located in the city of Caxias, in the State of Maranhão, which could suffer the effects of this crisis. As a central questioning of the research, we investigated how social actors in local justice have perceived Environmental Heritage in the Environmental Protection area of Inhamum, Caxias, Maranhão, in terms of its recognition, defense, protection and promotion? The public social actors of Environmental Justice in the Municipality of Caxias - judges, state justice prosecutors, federal prosecutors and lawyers who are members of the Environmental Thematic Commission - are located in the so-called “Judicial City”, and are responsible for defending these spaces. Therefore, as a general objective, it was necessary to analyze the Environmental Perception of social actors in local justice regarding the Municipal Environmental Protection area of Inhamum, Caxias, Maranhão, as Municipal Environmental Heritage, identifying the socio-environmental elements of the protection area; understanding its process of normative evolution for Heritage Protection in light of the Sustainable Development Goals in the 2030 Agenda; also identifying the training and educational profile of these actors, their perceptual movements and their constructions of belonging in this area. From a methodological point of view, regarding the method or type of research, we used a case study, through explanatory descriptive research, in which the elements related to the phenomenon of Environmental Heritage Perception were analyzed. The technical structural design of the research was also represented by bibliographic and documentary research. To carry out the study, survey research was used, through the application of semi-structured questionnaires. As for how it was approached, the research took on a qualitative-quantitative format. The research results demonstrated that fragmented environmental perceptions, devoid of interactions with the environmental areas with which decisions are made or postulated, can generate errors and collective procedural damages in the environmental field, thus requiring a functional and postural realignment with the SDG 16 – Peace, Justice and Effective Institutions, that is, greater quality and efficiency in environmental judicial decisions. Despite having legal competence to decide or postulate about the Inhamum APA, a significant portion of the subjects interviewed do not know, fully and in depth, the Local Conservation Unit or have only heard vaguely about the area, which demonstrated that they have a fragmented perceptual fabric. The subjects of environmental justice recognized that the Environmental Heritage in the municipality of Caxias is not preserved, requiring joint interventions. The construction of Environmental Perceptions – consistent with environmental causes – constitutes a cognitive and effective element of environmental constitutional filtering for access to a fairer legal order, from an ecological point of view, for present and future generations.
