A presente monografia visa analisar a evolução do trabalho escravo no Brasil, com ênfase no ciclo do trabalho escravo rural, comparando a escravidão do passado com sua manifestação contemporânea. O objetivo central é identificar os principais fatores que mantêm a prática da escravidão no contexto atual, especialmente nas áreas rurais, analisando as legislações nacionais e internacionais relacionadas ao tema. A pesquisa buscou avaliar o papel da Consolidação das Leis do Trabalho (CLT) e da Constituição Federal de 1988, observando a evolução histórica da escravidão e os mecanismos legais de combate a essa prática. Além disso, exploram as políticas públicas, os desafios enfrentados por auditores fiscais e instituições como o Ministério Público do Trabalho e a atuação da sociedade civil na denúncia dessas infrações. A metodologia adotada foi baseada na pesquisa de informações históricas, análise de leis e decretos, e levantamento de dados reais sobre a persistência da escravidão. Concluindo que, embora a escravidão formal tenha sido abolida, práticas análogas à escravidão continuam a existir, principalmente nas áreas rurais, sustentadas por fatores como a falta de educação de qualidade, racismo, desinformação e condições sociais precárias. As políticas públicas e as legislações, como a CLT e a CF/88, são fundamentais na luta contra a escravidão contemporânea, mas enfrentam desafios significativos na aplicação efetiva, principalmente devido à resistência estrutural e à falta de fiscalização adequada. A denúncia e a conscientização sobre o tema são essenciais para a erradicação desse problema.
This monograph aims to analyze the evolution of slave labor in Brazil, with an emphasis on the cycle of rural slave labor, comparing slavery in the past with its contemporary manifestation. The main objective is to identify the main factors that maintain the practice of slavery in the current context, especially in rural areas, by analyzing national and international legislation related to the subject. The research sought to evaluate the role of the Consolidation of Labor Laws (CLT) and the Federal Constitution of 1988, observing the historical evolution of slavery and the legal mechanisms to combat this practice. In addition, it explores public policies, the challenges faced by tax auditors and institutions such as the Public Ministry of Labor, and the role of civil society in reporting these violations. The methodology adopted was based on research of historical information, analysis of laws and decrees, and collection of real data on the persistence of slavery. Concluding that, although formal slavery has been abolished, practices analogous to slavery continue to exist, mainly in rural areas, sustained by factors such as lack of quality education, racism, misinformation, and precarious social conditions. Public policies and legislation, such as the CLT and the CF/88, are fundamental in the fight against contemporary slavery, but they face significant challenges in their effective implementation, mainly due to structural resistance and the lack of adequate monitoring. Reporting and raising awareness about the issue are essential to eradicating this problem.
