Resumo
A presente monografia tem como tema o Estatuto da Criança e do Adolescente, a Lei das Organizações Criminosas – Lei nº 12.850, de 02 de agosto de 2013, e a colaboração premiada. Delimita-se à viabilidade da aplicação da colaboração premiada no Brasil, tendo como agente o adolescente infrator e considerando os aspectos da Lei nº 8.069, de 13 de julho de 1990 - Estatuto da Criança e do Adolescente, bem como adicionalmente é um estudo à luz da Lei nº 12.850/2013. O estudo objetiva diagnosticar a possibilidade de aplicação da colaboração premiada ao adolescente infrator, considerando os aspectos da Lei nº 8.069/1990 e da Lei nº 12.850/2013. Também busca responder a questão sobre qual a viabilidade da aplicação da colaboração premiada no Brasil, tendo como agente o adolescente infrator? Como hipóteses há duas negativas. A primeira, tendo em vista se tratar de um meio de prova realizado por coautores e partícipes, a fim de alterar a execução da pena, sendo o adolescente uma vítima da corrupção, não está sujeito à aplicação da pena; e a segunda seguindo a linha de raciocínio da primeira hipótese, mas sob justificativa teórica diversa, é também negativa, enquanto o adolescente sujeito de aplicação de medida socioeducativa de remissão, estipulada no artigo 126 da Lei nº 8.069/1990 - Estatuto da Criança e do Adolescente, tem a seu favor exclusão do processo, independentemente da colaboração premiada. A metodologia adotada baseia-se em pesquisa explicativa e pesquisa descritiva, com a utilização de material bibliográfico, documental e pesquisa eletrônica.
This monograph has as its theme the Statute of the Child and Adolescent, the Law of Criminal Organizations - Law nº 12.850, of August 2, 2013, and the award-winning collaboration. It is limited to the viability of applying the award-winning collaboration in Brazil, having the adolescent offender as an agent and considering the aspects of Law nº 8.069, of July 13, 1990 - Statute of the Child and Adolescent, as well as additionally it is a study in the light of of Law No. 12.850/2013. The study aims to diagnose the possibility of applying the award-winning collaboration to the juvenile offender, considering the aspects of Law nº 8.069/1990 and Law nº 12.850/2013. It also seeks to answer the question about what is the feasibility of applying the award-winning collaboration in Brazil, having the juvenile offender as an agent? As hypotheses there are two negative ones. The first, considering that it is a means of proof carried out by co-authors and participants, in order to change the execution of the sentence, since the adolescent is a victim of corruption, he is not subject to the application of the sentence; and the second, following the line of reasoning of the first hypothesis, but under different theoretical justification, is also negative, while the adolescent is subject to the application of a socio-educational measure of remission, stipulated in article 126 of Law nº 8.069/1990 - Statute of the Child and the Adolescent, has in his favor exclusion from the process, regardless of the award-winning collaboration. The adopted methodology is based on explanatory research and descriptive research, with the use of bibliographic material, documents and electronic research.
